How do i get the document to prove i've never been married?
A lawyer said i should send for a copy of a new birth certificate and it should also state that i have not been married, is this correct?
If so who do i call/write to?

Reinformer is correct. A notarized attestation saying you have never been married would be your best bet. I wonder what you would even need this for though.
In my experience, proving a "negative" is extremely difficult (if at all possible depending on the facts). This is one of the reasons that people are (in theory) innocent until proven guilty. Usually, the burden of proof is on the person that is trying to demonstrate that you "did" something or that "something" actually occurred. There are of course exceptions.
For instance, in Texas, if a child is born to a married couple, it is "presumed" the husband is "presumed" to be the father. (however, this is easy enough to disprove biologically)
Another problem with proving you "haven't" been married is that some states recognize "common law" marriage; or you may have been "ceremonially" married, but not "legally" married.
So, I can't see that you would "prove" you haven't been married, but you can "swear/affirm under oath" that you have not been married.
What? You just goto the department of health. They'll have all your records, including if you have ever been married.

And your BC wouldn't say if you've been married or not. It just states when you were born, where you wer born, to whom you were born to.

I don't think your birth certificate will state whether or not you are now or have ever been married. It will, however, show your original name. Assuming you have never changed your name (something your birth certificate will not show), you can do a search of the court records in your county and obtain a certified copy. Assuming you have never been married in your county, that will establish it conclusively - at least under your original name - however, there are lots of counties in this country (and lots of countries in the world) so the fact that you've never been married in your home county will not prove that you have never been married anywhere. Only solution I can see is to sign an affidavit under oath and penalties of perjury to the effect that you've never been married. That may or not satisfy whoever is asking.
